1. Introduction
Hardik Dewan Foundation (“the Foundation”, “we”, “our”, or “us”) is a registered charitable trust operating in India. By making a donation through www.hardikdewan.com or any integrated payment gateway, including Razorpay, you agree to comply with the following Terms and Conditions.

2. Nature and Use of Donations
All contributions received by the Foundation are treated as charitable donations. Funds are used solely for the Foundation’s social welfare objectives including, but not limited to, environmental conservation, youth development, hunger alleviation, education, public service programmes, and other approved activities within the mandate of the Trust.

3. Eligibility to Donate
a. Donors must be individuals, companies, or entities legally able to contribute funds in India.
b. Indian donors are required to provide valid identity information, including full name, contact details, and PAN for contributions equal to or exceeding the prescribed statutory limit. (Via Email [office@hardikdewan.com] or Donation Form.)
c. International donations may be accepted subject to compliance with relevant laws applicable at the time of contribution and prior approval of the Foundation, wherever required.

4. Payment Gateway
Donations made through Razorpay or any other integrated service are processed securely. The Foundation is not responsible for:
• technical failures outside our control
• banking errors
• failures arising from network or system downtime
Confirmation of payment shall be provided via email or SMS where applicable.

5. Non-Refund Policy
Donations made to the Foundation are final and non-refundable.
No cancellation, chargeback, refund or return will be entertained once a contribution has been successfully processed.
Donors are therefore advised to verify the amount, purpose, and details carefully before completing the transaction.

6. Receipts and Tax Benefits
a. The Foundation issues donation receipts for all eligible contributions in alignment with Indian tax law.
b. Donors eligible for tax deductions under Section 80G of the Income Tax Act, 1961 must provide required details, including PAN.
c. The issuance of tax benefit certificates is conditional upon receipt acknowledgment, donor information verification, and government-mandated compliance.

7. Data and Record Keeping
Information submitted while donating is treated with strict confidentiality and used only for regulatory, accounting, and reporting purposes.
The Foundation does not share donor details with unrelated external parties unless legally required.

8. Misuse, Fraud or Unauthorised Transactions
If a donor suspects fraudulent activity, the Foundation must be contacted immediately.
Any suspected misuse or incorrect transfer will be investigated with the bank and payment processor, but refunds remain subject to Clause 5.
9. Limitation of Liability
The Foundation shall not be held liable for:
• indirect losses
• consequential or incidental damages
• loss of data, goodwill, or opportunity
arising from donation processing or use of this website.

10. Modification of Terms
The Foundation reserves the right to amend or update these Terms at any time without prior notice.
Revised terms shall become effective upon being posted on the Foundation’s website.

11. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of India.
Any dispute, claim, or legal proceeding arising from donations or the use of the website shall fall exclusively under the jurisdiction of courts at Gurugram, Haryana.
